PRIVACY POLICY

 

This privacy policy governs your use of the software application FETCHSTR (“Application”) for mobile devices that was created by Fetchstr. The Application facilitates peer-to-peer transport and delivery of goods and proves an online marketplace for the peer-to-peer transport and delivery of goods.

 

What information does the Application obtain and how is it used?

User-Provided Information 

The Application obtains the information you provide when you download and register the Application. Creation of an account with us is mandatory in order to be able to use the basic features of the Application.

General Information

When you create an account with us and use the Application, you generally provide (a) your name, email address, age, user name, password, telephone number, university or college where you are located, and other registration information; (b) transaction-related information, such as when you place orders, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; and; (d) information you enter into our system when using the Application, such as contact information and project management information. If you either register for the Application with a third party social media provider (such as Facebook) or link your account with such a social media provider to the Application, we will receive access to information from your Facebook profile, such as your name, gender, pictures and “friends” on the account.

This information is used to match people who are placing orders to people who wish to “fetch” orders and to resolve any issues relating to orders. We may also use the information you provided to us to contact you from time to time to provide you with important information, required notices and marketing promotions.

Payment Information

In order to use the Application’s “order” feature, you will need to provide credit card information to pay for an order. Likewise, in order to use the Application’s “fetch” feature, you will need to provide banking information for the bank account into which you want payments to be transferred. All of our payments are processed by Stripe, a third party service provider. Please review Stripe’s FAQ should you have any questions or concerns about your credit card payment information (https://stripe.com/help/security) or if you have questions or concerns about receiving payment for your “fetch” (https://stripe.com/help/transfers). Stripe may require additional personal information in order to process payments- all personal information disclosed to Stripe will be subject to Stripe’s privacy policy (https://stripe.com/us/privacy), and all transactions processed by Stripe will be subject to Stripe’s terms of use, which you should review closely. Stripe will use your payment information and contact information to generate receipts in connection with an order or “fetch”.

Payment information is used only for payment purposes. We do not store full credit card or other banking information on Fetchstr servers and do not have access to this information.

“Order” Specific Information

You also provide information regarding products or services covered by “orders” to us, as well as pick-up and drop-off locations when ordering.  We do retain information regarding the orders you have placed and “fetches” you have completed.

We use this information to facilitate “orders” and “fetches.” When you place a notification for an order, your order information is available to other members of the Fetchstr community near your location.

During the time period that a “fetch”/delivery is active, both the person who placed the order and the person who is “fetching” the order are automatically permitted access to each other’s telephone numbers so that they can communicate directly if there is a problem with the order. By placing an order or agreeing to make a “fetch,” you are consenting to the disclosure of your telephone number to the other user. We do not monitor or record telephone calls or text messages exchanged. We do not receive/retain information regarding timing or duration of telephone calls, or the content of text messages exchanged.

 

Automatically Collected Information 

 Please see below for a detailed discussion of the Application’s collection and use of location information.

In addition, the Application may collect certain technical information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. 

If you connect the Application to social media providers, we may automatically receive additional information from these social media providers. Please review their respective terms of use/privacy policies.  Further, if you connect to the Application via a third party service (such as API providers), we may share information about your use of the Application with that third party provider. We may also share your information with third party providers to create offers that may be of interest to you.

We use this information to provide customer support, to analyze usage patterns, to troubleshoot bugs or other technical issues, and to improve or expand the Fetchstr experience.

 

Does the Application collect precise real time location information of the device?

When you initially open the Application and while the Application remains open, we automatically receive information about your location. Each time you open the Application, your location information is automatically updated. We update your location data in order to display potential “fetch” requests in your proximity in the Application and to send you alerts about nearby pending “fetch” requests.  If you have selected the “Always Allow Location Access” option, if the Application is in the background, your location information will be automatically refreshed periodically. We may use GPS technology (or other similar technology) to determine your current location in order to display a location map with relevant notifications. We will share your current location with other users of the Fetchstr community or third party partners. However, your location refreshes each time the Application is closed (or periodically if you have selected the “Always Allow Location Access” option) and we do not retain past location information. We need your location information in order to match people placing orders and “fetchstrs”.

When you use the “Shout” feature, your GPS location is automatically collected and other members of the Fetchstr community in the area receive notifications of your location in order to solicit potential orders. Use of this feature is optional. When you are “fetching”, real-time GPS technology is also used to determine your location in order to assist you in navigating to the “pick-up” and “drop-off” locations. When you use the “Shout” feature and during an order/delivery, other users of the Application will also be able to see your profile information.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the Application located in your account settings or in your mobile phone settings and/or within the Application. This will limit the function of the Application, however.

 

Do third parties see and/or have access to information obtained by the Application?

Yes. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose user-provided information and automatically collected information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with our trusted third party services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement;
  • to improve the Application’s performance;
  • if Fetchstr is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

 

What are my opt-out rights?

You can stop all further collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at support@fetchstr.com.

You can use your device settings to limit receipt of push notifications, although this may impact the functionality of the Application.

You can also enable or disable the Facebook Connect feature to limit the Application’s access to this information.

 

Data Retention Policy, Managing Your Information

We will retain user-provided information for as long as you use the Application and for a reasonable time thereafter. We will retain automatically collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete user-provided information that you have provided via the Application, please contact us at support@fetchstr.com and we will respond in a reasonable time. Please note that some or all of the user-provided information may be required in order for the Application to function properly.

 

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@fetchstr.com. We will delete such information from our files within a reasonable time.

 

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

 

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy on our website at www.fetchstr.com and informing you via email or text message. You are advised to consult this Privacy Policy regularly for any changes, as continued use after such changes shall constitute your consent to all changes.

 

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/mobile device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards. If you are a resident of California, in addition to the rights set forth herein, the California Civil Code may permit you to request further information from us regarding how we share certain categories of personal information with third parties for their direct marketing purposes.
